WaterXtender™ may add to, change or remove any part of the site, including, without limitation, any content therein, at any time without prior notice to you.

Personal Information

Customers agree to provide accurate, current, and complete information as required for the purchase of products. WaterXtender™ reserves the right to block further sales to customers who provide false, inaccurate or incomplete data. Customers acknowledge that WaterXtender uses a third party payment processing service to process orders and bill fees to your credit card.

TERMS OF SALE

Sales of Products to End Users Only

WaterXtender™ sells landscaping supplies from the site to end-user customers who make purchases only for their own personal, non-commercial use. You may not purchase products for further distribution or resale or for any other commercial or business purpose.

Pricing

WaterXtender™ reserves the right to change prices for products at any time, and does not provide price protection or refund in the event of promotions or price decreases.

Refund / Return Policy

If you are dissatisfied with the product for any reason, WaterXtender™ will refund the amount paid for the product and all associated shipping. WaterXtender is not liable for products damaged or lost in transit to WaterXtender. WaterXtender will credit the amount paid once the product is returned, to the credit card or payment method you used to make the original purchase. Please keep in mind that credit card companies can vary in the time they take to credit your account. Please allow at least one full billing cycle for refunds to appear on your statement.

WaterXtender™ will not provide a refund for a request received past 30 days after the original purchase date. WaterXtender does not provide a refund if the product has not been applied as directed on the packaging.

Incorrect or Missing Items

Damaged Products

It is important for you to inspect your package and product for visible damage before the carrier leaves. Note any such damage on the delivery receipt in writing with the driver if possible. In case of freight damage, contact the carrier directly to make a claim. We recommend you retain any original packaging material and outer cartons until your claim is resolved.

SHIPPING

Shipping

Items in stock are normally shipped within 48 hours of receipt of order. You will be advised of any delay of more than one week. Upon shipment, we will send you a notification at the email address you provided with your order. The carrier’s charges for the selected shipping method are shown on the shipping calculator for your order prior to purchase. Please be aware that some carriers do not provide one-day service to some locations.

LIABILITY

IN NO EVENT SHALL ANY WATERXTENDER PARTY BE LIABLE TO YOU, OR ANY THIRD PARTY, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, RELIANCE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, LOSS OF VALUE OF THE PRODUCTS OR LOSS OF USE OF THE PRODUCTS, WHETHER BASED ON BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION, BREACH OF CONTRACT OR TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OR STRICT LIABILITY), EVEN IF A WATERXTENDER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF, NOTWITHSTANDING THE FOREGOING, A WATERXTENDER™ PARTY IS FOUND TO BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGE OR LOSS WHICH ARISES UNDER OR IN CONNECTION WITH YOUR USE OF THE SITE, CONTENT, OR PRODUCTS, THE RELEVANT WATERXTENDER’S TOTAL CUMULATIVE LIABILITY SHALL IN NO EVENT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID WATERXTENDER FOR THE PRODUCTS, AS APPLICABLE; AND (B) THE SUM OF ONE HUNDRED US DOLLARS (US$100).

NOTHING IN THIS SECTION SHALL EXCLUDE OR LIMIT ANY WATERXTENDER™ PARTY’S LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW, IN WHICH CASE, AND SUCH WATERXTENDER PARTY’S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
